
Seasonal Lease: sample
Sample for information. This is not an offer and not legal advice. This is the model seasonal lease Global Homebase intends to use for stays of more than 31 days. It is being reviewed by our Spanish lawyer. The signed lease, in Spanish and English, is the only binding version. Square brackets show what is filled in for each stay.

1. The property

2. Why this lease is temporary
This is a lease for seasonal use. It is not a lease of the tenant's habitual residence. It is governed by article 3 of the Urban Leases Act 29/1994 (LAU), as amended by Royal Decree-law 26/2026.
The Tenant keeps their habitual residence at the address above. The Tenant is temporarily away from it for the following real and verifiable reason:
- ☐ Work or a professional project in Mallorca, from [ ] to [ ]
- ☐ Study or research at [institution]
- ☐ Medical treatment of the Tenant or a family member
- ☐ Assessing a move or a property purchase in Mallorca, including viewings and a trial stay before buying, with [Global Homebase / named agent]

The Tenant attaches proof of the habitual residence and of the reason in Annex 1. Examples:
- Habitual residence: a tax residence certificate, a recent utility bill or a registration certificate.
- Reason: an employer's letter, an enrolment letter, a medical appointment, or a property-search mandate with viewings booked.
The Tenant confirms that the information and documents are true. The Tenant agrees to tell the Landlord straight away if the reason ends before the lease does.
3. Term
Term: from [date] at [17:00] to [date] at [10:00]. That is [ ] days. The term is more than 31 days and no more than [11] months.
The lease ends on that date without notice and without tacit renewal. Articles 9 and 10 LAU (minimum term and extensions for habitual residences) do not apply.
The term can be extended once, in writing, only if the same temporary reason continues and is documented again. The total term may not exceed 12 months. The parties will not sign more than two consecutive seasonal leases for this property.
4. Rent
Rent: €[ ] per month, or €[ ] for the whole term.
Due: [in advance on the 1st of each month / [ ]% on signing and the balance before the key handover].
How paid: by transfer to the account in the Landlord's or manager's name, IBAN [ ]. The Landlord issues a receipt or invoice for every payment.
The rent is fixed for the term.
5. Utilities and costs
The rent includes:
- water
- Wi-Fi
- community and garden costs
- pool maintenance
- IBI
- the Landlord's home insurance
Electricity is included up to [ ] kWh per month. Use above that is charged at the actual price per kWh on the supplier's invoice, against a meter reading taken at check-in and at check-out, with a photo of the meter. [Bottled gas / heating oil: charged at cost if used.]
No fees for management or for preparing this lease are charged to the Tenant, directly or indirectly.
6. Optional services
The Tenant may order the following from Global Homebase or independent providers, under a separate order and at separate prices:
- extra cleaning
- linen changes
- a private chef
- a car
- transfers
- other services
They are not part of the rent, and the lease does not depend on them.
7. Deposit and guarantee
Statutory deposit (fianza): on signing, the Tenant pays [one / two] month's rent, €[ ]. The Landlord lodges it with the Balearic Government's deposit register (IBAVI), as Balearic law requires.
Additional guarantee: [none / €[ ]], no more than one month's rent.
Both are returned within [30] days after the Tenant hands back the keys. The Landlord may deduct only:
- unpaid rent or electricity
- damage beyond normal wear and tear, documented against the inventory with photos and invoices or quotes
8. Handover and inventory
The property is handed over clean, in working order and with the inventory in Annex 2. The parties check it at check-in and sign it, with photos.
The Tenant has [48] hours to report anything missing or not working. On departure, the parties check the property against the same inventory.
9. Use of the property
The Tenant will use the property as a private home for the occupants named in this lease, for the reason in section 2. The Tenant will not:
- sublet, assign the lease or let rooms, in whole or in part, including through any platform
- let more than [ ] people stay overnight
- use the property for a business open to the public, events or parties without the Landlord's written consent
- make alterations or works
- keep pets without written consent ([consent given for: ])
- behave in a way that disturbs neighbours or breaks the house rules in Annex 4, which cover quiet hours, fire safety, pool safety and water use
The Tenant may register (empadronarse) only where the law requires it. Registering does not change the temporary nature of this lease.
10. Repairs and access
The Landlord keeps the property habitable and carries out the repairs needed. The Landlord acts on urgent repairs straight away, and on other repairs within five working days of being told.
The Tenant reports any fault immediately. The Tenant pays for small repairs caused by everyday use and for damage caused by the occupants.
The manager's house team looks after the pool and garden on [days/frequency]. They may enter the property for that, and for repairs, with 24 hours' notice, or without notice in an emergency.
11. Insurance
The Landlord insures the building and contents, with liability cover. That insurance does not cover the Tenant's belongings or the Tenant's own liability. The Tenant is advised to take out insurance for both. The manager can offer cover through its insurance partner.
12. Ending the lease early
By the Tenant: the Tenant may leave early with [30] days' written notice. The Tenant then owes [the rent up to the end of the notice period / a fee of one month's rent], unless the property is let to someone else for that period.
By the Landlord: the Landlord may end the lease if:
- the rent or the electricity is not paid within [10] days of a written reminder
- the property is sublet, or used by more people than allowed
- there is serious damage, nuisance or illegal activity
- the information in section 2 turns out to be false
These reasons follow article 35 LAU and article 1124 of the Civil Code.
13. Hand-back
On the last day, the Tenant returns all keys and leaves the property clean and as received, apart from normal wear and tear.
For each day the Tenant stays beyond the end date without the Landlord's written consent, the Tenant pays [twice] the daily rent as compensation. The Landlord also keeps its other legal remedies.
14. Personal data
Mallorca Homebase S.L. processes the parties' data to prepare and perform this lease, to lodge the deposit and to meet legal and tax duties. Details are in the privacy policy at globalhomebase.com/privacy.
15. Notices
Notices are sent by email to the addresses above, with a copy by burofax or registered post where the law requires it.
16. Law, language and courts
This lease is governed by Spanish law, in this order:
- the agreement of the parties
- Title III of the LAU
- the Civil Code
It is signed in Spanish and English. If they differ, the Spanish version prevails. The courts where the property is located have jurisdiction.
